Según la doctrina del “discurso del odio”, todo mensaje calificable como tal supondrá por definición un abuso del derecho fundamental a la libertad de expresión. Esta doctrina, elaborada en distintas etapas por el TEDH a lo largo de las últimas décadas, ha sido seguida por la jurisprudencia española como pauta interpretativa de los llamados “delitos apologéticos”. En atención a esta linea, la ratio legis de este grupo de delitos consistiría, simplemente, en la prohibición del discurso del odio. La vaguedad de (...) esta idea ha llevado a un sector doctrinal a abandonar el paradigma del bien jurídico, para defender como alternativa la distinción entre daño y ofensa. En el presente trabajo se expondrán y valorarán críticamente los presupuestos y efectos de la “doctrina del odio” y se relativizará la eficacia práctica del binomio “daño-ofensa”, para llegar a una conclusión común: ambas concepciones son tautológicas. Il est tout à fait possible de soutenir que l’espace de Newton manque d’objectivité physique (ce qui est un corollaire de la théorie einsténienne) et néanmoins prendre tout à fait au sérieux la thèse de l’espace euclidien comme condition de possibilité de l’expérience. Condition de possibilité de l’émergence d’un sujet qui configure son monde en remettant tout point de son environnement à une métrique. Cette métrique ne serait autre que celle qui donne sens à la géométrie que l’on a appris (...) à l´école, c’est à dire, la métrique euclidienne. Tout en manquant de réalité physique, tout en n`étant pas fertile à l’heure de rendre compte de la forme de l’univers, la métrique euclidienne serait la seule modalité sous laquelle il y aurait pour l’homme une prise sur le monde. Qu’on l’appelle ou pas transcendantale, la reconnaissance de la métrique euclidienne comme condition de possibilité de l’expérience nous rapprocherait de Kant sans pour autant répudier Einstein ou Poincaré. It is well known that the history of Calculus in the nineteenth century coincides with the process of substitution of infinitesimals by the notion of limit. But it is adviseable to keep in mind the ontological implications of that process.We can find a background for this ontological approach in Abraham Robinson’s Non-Standard AnaIysis and “The Metaphysics of the Calculus”. Bajo el concepto común de gamificación existe un complejo mundo dentro del cual existen distintas opciones, cada una con su denominación, que para quien se adentra por primera vez en él pueden generar confusión. Cada una de ellas goza de características, funciones y elementos metodológicos propios. ¿Gamificación? ¿Juegos serios? ¿Aprendizaje Basado en Juegos? Ante esta amalgama de posibilidades, las siguientes líneas se presentan a modo de hoja de ruta que ayude a transitar por la senda del juego educativo, para lo (...) que, a su vez, se acompaña esta fundamentación teórica con un ejemplo didáctico de ABJ -editado como juego de mesa bajo la denominación “Catedral 1221”- concebido y diseñado con la finalidad de promover y facilitar el estudio de la Edad Media en la Educación Secundaria Obligatoria. Su aplicación con éxito en las aulas permite aportar orientaciones didácticas al respecto y extraer conclusiones relativas a la conveniencia y validez académica del juego en el marco de la enseñanza reglada. University students will be our future business leaders, and will have to address social problems caused by business by implementing solutions such as social entrepreneurship ventures. In order to facilitate the learning process that will foster social entrepreneurship, however, a more holistic pedagogy is needed. Based on learning theory, we propose that students’ social entrepreneurship actions will depend on their learning about CSR and their absorptive capacity. We propose that instructors and higher education institutions can enhance this absorptive capacity by (...) exploiting Web 2.0 technologies. We tested our proposition with a sample of 425 university students using structural equation modeling and found support for the proposed relationships. (shrink)

El objetivo de este artículo es realizar una propuesta didáctica atractiva y motivadora que favorezca la implicación del alumnado universitario en las asignaturas vinculadas a la Historia económica. A través de una metodología propia de la Historia Oral se pretende establecer un vínculo entre los estudiantes, las técnicas de investigación historiográfica y la evolución histórica de su región en materia económica y social. Los resultados de este proyecto confirman que su aplicación hace el proceso de aprendizaje más significativo, conecta a (...) sus participantes con el mundo que les rodea y les ayuda a comprender cómo se hace y se escribe la historia. El propósito de esta investigación es hacer una relectura histórico-crítica de la Ética de la Liberación como ética de la vida. Este planteamiento se hace desde la memoria política crítica que permitirá ver la influencia que ella ha tenido con otras éticas que hoy pueden agruparse en torno al concepto de convivencia: la ética intercultural, la ética ecológica, la ética de la economía solidaria, la ética de una ciencia construida socialmente y de una tecnología al servicio de las personas, la (...) ética educativa como expresión de apertura y diálogo y no como adoctrinamiento, la ética religiosa separada de todo fanatismo, la ética civil más allá de todo militarismo, la ética del género más allá de toda exclusión. Lo que implica la necesidad de consolidar una ética de la convivencia, como eje central de la cultura y de la vida de los habitantes de América Latina que no es sólo necesario estudiar sino practicar. Las aulas son contextos donde las emociones forman parte del proceso de aprendizaje. Las habilidades emocionales del docente son claves para fomentar ambientes de aprendizaje positivo. Pero ¿Cómo ayudan al profesorado y al alumnado?, ¿Cómo podemos mejorar las habilidades emocionales?, ¿Qué programas existen? Este trabajo aporta evidencias y recomendaciones útiles para el desarrollo de programas de inteligencia emocional con docentes.

El presente artículo describe un proyecto de innovación educativa de aprendizaje de competencias, realizado en el Curso Propio de Liderazgo de la Universidad San Pablo CEU, transversal a toda su oferta educativa. Se trata de nuevo proyecto basa- do en una docencia híbrida, donde las masterclass más teóricas se han complemen- tado con un aprendizaje basado en retos vinculados a materias de comunicación y sostenibilidad, aplicando la metodología Design Sprint. Diseases of complex origin have a component of quantitative genetics that contributes to their susceptibility and phenotypic variability. However, after several studies, a major part of the genetic component of complex phenotypes has still not been found, a situation known as “missing heritability.” Although there have been many hypotheses put forward to explain the reasons for the missing heritability, its definitive causes remain unknown. Complex diseases are caused by multiple intermediate phenotypes involved in their pathogenesis and, very often, each one (...) of these intermediate phenotypes also has a component of quantitative inheritance. Here we propose that at least part of the missing heritability can be explained by the genetic component of intermediate phenotypes that is not detectable at the level of the main complex trait. At the same time, the identification of the genetic component of intermediate phenotypes provides an opportunity to identify part of the missing heritability of complex diseases. (shrink)

Vigorous Fodorian criticism may make it seem impossible for Inferential Role Semantics (IRS) to accommodate compositionality. In this paper, first, I introduce a neo-Fregean version of IRS that appeals centrally to the notion of rationality. Second, I show how such a theory can respect compositionality by means of semantic rules. Third, I argue that, even if we consider top-down compositional derivability: a) the Fodorian is not justified in claiming that it involves so-called reverse compositionality; and b) a defender of IRS (...) can still offer a satisfactory account in terms of the inferential capacities of rational thinkers. Researchers working in the field of ecosystem services (ES) have long acknowledged the importance of recognising multiple values in ecosystems and biodiversity. Yet the operationalisation of value pluralism in ES assessments remains largely elusive. The aim of this research is to present a taxonomy of values and valuation methods to widen the evaluative space for ES. First, we present our preanalytic positions in regards to the values and valuation of ES. Second, we review different value definitions that we deem relevant (...) for the discussion of ES valuation. Third, we propose a taxonomy of ES values based on different conceptions of human-nature relationships. Finally, we present a taxonomy of different methods that can be used to recognise plural values in ES. This taxonomy for a plural valuation can help ES scientists and practitioners with their aim of representing people's multiple and context-specific ways of valuing nature. The taxonomy can also serve to pay broader attention to ES values that are overlooked or misrepresented in assessments that restrict their focus to monetary valuations. (shrink)

Focusing on the constitutional changes undergone since 2005 in Iraq, Sudan, Morocco, Tunisia and Egypt, this article explains how the constitutional limitation clauses affected the respective material constitutional transformations. The explanatory value of the limitation clauses is tested, with possible causalities (as well as non-causal relations) explored through a case study. Generalizing research arguments are offered, theorizing about the material constitutional transformation processes in authoritarian and post-authoritarian scenarios. The research arguments shed light on the limitation clauses’ potential to reveal the (...) policy intent underlying the constituent power, as well as their negative implications for a proper democratic consolidation, their effects in keeping dynamics of political immobilism, and their consequences in terms of favouring instances of authoritarian regression. The 3-valued paraconsistent logic Ciore was developed by Carnielli, Marcos and de Amo under the name LFI2, in the study of inconsistent databases from the point of view of logics of formal inconsistency (LFIs). They also considered a first-order version of Ciore called LFI2*. The logic Ciore enjoys extreme features concerning propagation and retropropagation of the consistency operator: a formula is consistent if and only if some of its subformulas is consistent. In addition, Ciore is algebraizable in the sense of (...) Blok and Pigozzi. On the other hand, the logic LFI2* satisfies a somewhat counter-intuitive property: the universal and the existential quantifier are inter-definable by means of the paraconsistent negation, as it happens in classical first-order logic with respect to the classical negation. This feature seems to be unnatural, given that both quantifiers have the classical meaning in LFI2*, and that this logic does not satisfy the De Morgan laws with respect to its paraconsistent negation. The first goal of the present article is to introduce a first-order version of Ciore (which we call QCiore) preserving the spirit of Ciore, that is, without introducing unexpected relationships between the quantifiers. The second goal of the article is to adapt to QCiore the partial structures semantics for the first-order paraconsistent logic LPT1 introduced by Coniglio and Silvestrini, which generalizes the semantic notion of quasi-truth considered by Mikeberg, da Costa and Chuaqui. Finally, some important results of classical Model Theory are obtained for this logic, such as Robinson’s joint consistency theorem, amalgamation and interpolation. Although we focus on QCiore, this framework can be adapted to other 3-valued first-order LFIs. (shrink)

We examine the unique nature of agency problems within publicly traded family firms by investigating the earnings management decision of dominant family owners relative to non-family. To do so, we draw upon literature demonstrating that family owners are loss averse with respect to the family’s socioemotional wealth, or the affective endowment derived from firm ownership and control. Our theory and findings suggest that potential reputational consequences of earnings management lead family principals to engage in less of this practice relative to (...) non-family firms, and that founder family firms are less likely than non-founder family firms to use earnings management. Moreover, the family-firm effect varies with the firm size, the degree of CEO entrenchment, and the firm’s stock structure. We provide important insights regarding differences between family and non-family principals in the use of unethical accounting practices, thereby extending agency theory and advancing an underdeveloped research area. The use of images in education has received little attention despite the dual role of images in school textbooks, one aimed at the acquisition of knowledge and the other at the transmission of attitudes, values and norms, that constitute a valuable source of historical, educational and communicative research. We will study, through the analysis of content, the characteristics of the catechisms, the legislation of the time related to the publication of school textbooks, the presence of images, types, the didactic function (...) and the transmission of social models and ideology. The research suggests that the images of school catechisms are not simply reflections of a reality that facilitates the learning of the contents taught in schools, but that they also become an effective tool in the transformation of the values and ideological thinking of the social context in which they are produced. The aim of this paper is to define a partial Propositional Type Theory. Our system is partial in a double sense: the hierarchy of (propositional) types contains partial functions and some expressions of the language, including formulas, may be undefined. The specific interpretation we give to the undefined value is that of Kleene’s strong logic of indeterminacy. We present a semantics for the new system and prove that every element of any domain of the hierarchy has a name in the (...) object language. Finally, we provide a proof system and a (constructive) proof of completeness. (shrink)

Studies of individuals under conditions of confinement or severe social and physical restrictions have consistently shown deleterious mental health effects but also high levels of adaptability when dealing with such conditions. Considering the role of physical activity and sport in psychological adaptation, this paper describes a longitudinal study to explore to what extent the imposed restrictions due to the outbreak of SARS-CoV-2 may have affected athletes’ mental health outcomes and how far the process of adaptation to confinement conditions is differentially (...) affected depending on whether the sports activity was practiced individually or in a group, and outdoors, indoors, or both. Two hundred and seventy-four athletes were assessed over 7 weeks using the GHQ-28 and an ad hoc survey exploring the practice of physical activity. A mixed-model fixed effects ANCOVA was used to analyze the effects of time, place, and company in which the sport was practiced, with an index of the amount of physical activity expended as a covariate. Results show a significant effect of time in three out of four of the GHQ-28 subscales, in all cases showing a consistent adaptation to conditions over time. Results also show that playing sport indoors, outdoors, or both, and practicing alone vs. with others differentially affect the somatic symptoms exhibited during confinement: Athletes who practiced sport with others showed higher levels of somatic symptoms at the beginning of the set of data but a quicker rate of adaptation. Differences arising from practicing sport alone or with others were more pronounced in the case of indoor sports, which could be related to the fact that physical activity that can be practiced during confinement is more similar to that practiced indoors alone. Implications relating to what sport psychologists and other health professionals may offer to athletes in stressful situations are discussed. (shrink)

We draw on the behavioral agency model to explore the ethical consequences of CEO equity incentives. We argue that CEOs are more concerned with funding pension plans when they have more to gain from their stock options yet will increasingly underfund employee pension funds as their current option wealth increases. Our findings reveal that both effects hold when the CEO has greater power (also occupying board chair) over firm decision making. Our study suggests that there is an ethical dimension to (...) equity incentives, given they are intended to align CEO interests with shareholders, yet potentially incentivize CEO behaviors with adverse consequences for employees. Insights from our findings provide boards and regulators with behavioral levers to protect employee well-being in the context of pension funding. (shrink)

The article attempts to verify that inappropriate use of information provided by the media can increase risks for persons who are susceptible to mental illness. The impact of Colombian news in 2014 related to the word suicide was studied to that end. The news was analyzed subsequently through a survey with eight questions applied by two members of the group who had been trained to conduct the study. The idea was to delve deeper and to see the effect of the (...) media and its stigmatization. Nowadays, adolescents are more exposed to situations in which their mood can be affected by improper use of the media, bearing in mind that the worst outcome would be that it leads to suicidal behavior. This study draws upon the behavioral agency model and the concept of socioemotional wealth to investigate how family firms’ employee pension underfunding decisions differ from those of non-family firms. We explore how these differences are influenced by financial distress, generational stage, and whether the firm is eponymous. We test our hypotheses using data from 452 US firms over an eleven-year period. Our results suggest that family firms are less likely to underfund pensions, but this effect is attenuated in later generational (...) ownership stages and in non-eponymous firms. (shrink)

A hemi-implicative lattice is an algebra \((A,\wedge,\vee,\rightarrow,1)\) of type (2, 2, 2, 0) such that \((A,\wedge,\vee,1)\) is a lattice with top and for every \(a,b\in A\), \(a\rightarrow a = 1\) and \(a\wedge (a\rightarrow b) \le b\). A new variety of hemi-implicative lattices, here named sub-Hilbert lattices, containing both the variety generated by the \(\{\wedge,\vee,\rightarrow,1\}\) -reducts of subresiduated lattices and that of Hilbert lattices as proper subvarieties is defined. It is shown that any sub-Hilbert lattice is determined (up to isomorphism) by (...) a triple (_L_, _D_, _S_) which satisfies the following conditions: _L_ is a bounded distributive lattice, _D_ is a sublattice of _L_ containing 0, 1 such that for each \(a, b \in L\) there is an element \(c \in D\) with the property that for all \(d \in D\), \(a \wedge d \le b\) if and only if \(d \le c\) (we write \(a \rightarrow _D b\) for the element _c_), and _S_ is a non void subset of _L_ such that _S_ is closed under \(\rightarrow _D\) and _S_, with its inherited order, is itself a lattice. Aim: The present work proposes the study of the neuromotor activity of the masseter-jaw-tongue articulation during diadochokinetic exercising to establish functional statistical relationships between surface Electromyography, 3D Accelerometry, and acoustic features extracted from the speech signal, with the aim of characterizing Hypokinetic Dysarthria. A database of multi-trait signals of recordings from an age-matched control and PD participants are used in the experimental study. Hypothesis: The main assumption is that information between sEMG and 3D acceleration, and acoustic features may be quantified (...) using linear regression methods. Methods: Recordings from a cohort of eight age-matched control participants and eight PD participants were collected during the utterance of a diadochokinetic exercise. The dynamic and acoustic absolute kinematic velocities produced during the exercises were estimated by acoustic filter inversion and numerical integration and differentiation of the speech signal. The amplitude distributions of the absolute kinematic and acoustic velocities are estimated to allow comparisons in terms of Mutual Information. Results: The regression results show the relationships between sEMG and dynamic and acoustic estimates. The projection methodology may help in understanding the basic neuromotor muscle activity regarding neurodegenerative speech in remote monitoring neuromotor and neurocognitive diseases using speech as the vehicular tool, and in the study of other speech-related disorders. The study also showed strong and significant cross-correlations between articulation kinematics, both for the control and the PD cohorts. The absolute kinematic variables presents an observable difference for the PD participants compared to the control group. Conclusion: Kinematic distributions derived from acoustic analysis may be useful biomarkers toward characterizing HD in neuromotor disorders providing new insights into PD. (shrink)

Este artículo tiene como objetivo determinar cuál es el valor filosófico de la anaideia -ἀναίδεια- (desvergüenza) y su relación con la parresia -παρρησία- (franqueza, libertad de palabra) en Diógenes de Sinope. Se lleva a cabo una lectura, análisis e interpretación de fuentes clásicas sobre la escuela cínica, y particularmente del libro VI de Diógenes Laercio “Vidas y sentencias de los filósofos más ilustres”, texto clave en los estudios sobre el cinismo. El resultado de este análisis es que en esos textos, (...) se representa a un Diógenes de Sinope asumiendo gestos y réplicas de palabra en las que el aidós y la moderación no resultan propios de su actitud filosófica, razón por lo cual la anaideia es considerada como una afirmación de la libertad frente a la crítica que establece el filósofo respecto a la vida civilizada y artificial. Se concluye que para valorar de manera positiva el cinismo de Diógenes y vincularlo a toda la tradición griega que privilegia la razón y la virtud, es necesario valorar el estatuto ético y filosófico de la parresía: libertad de palabra, franqueza.
